We spent little more than a month together before I had to leave. I left for Australia to visit family before returning to the UK and by way of huge coincidence, she was in Melbourne at the exact same time as me so we got another month together.

Then after a long and grueling 9 months apart, I have finally, just got back to the states to see her again. I quit my job, put nearly 2 grand in to the trip and am halfway in to my 2 month stay with her. I am currently on an ESTA visa and have no intention of working here but now I'm back with this girl, I can't be without her.

My issue is this; As I went through customs and immigration on this visit, the intended length of stay 2 months raised concerns and I was taken to secondary screening.

Also, the fact that I had only a year previously, been a worker here, may have added to their suspicions. I was grilled for nearly an hour on my intentions this time round and I answered completely honestly.

Visiting my girlfriend, trying to make a long distance relationship work. Pretty much gave her the back story of how we met and everything that had led to this point. The customs lady went through my phone, my laptop, my emails and my luggage, telling me she was convinced I was coming to work.

Like I previously stated, I absolutely wasn't and haven't. I don't want to jepordise a possible future out here with this girl so am doing everything by the book. I showed her my return ticket which did a lot to back up my intention of leaving at Xmas. There are ways of showing the balance of these cards but the lady was not willing to go through the processes on the internet. I'm talking no longer than a month later. I know I'm going to be under intense scrutiny again and will be better prepared.

I'm dipping heavily in to my savings in order to fund this trip and my stay and will have a bank statement to show exactly what I have. I'll once again have a return ticket etc etc.

But what exactly should I say? I'm sure their biggest concern will be the short space of time between visits, the long length if time of each visit even though not breaching Visa waiver 90 day limit and my intentions with this girl.

If they think I intend to marry her, will that impede or help my case? Should I say that my purpose of visiting this time is to propose to this girl or should I just say I am just visiting her again?

Finally, if I am turned away at immigration for whatever reason, do I get the money for my flight back or am I out pounds on top of having my dreams crushed. I do know that back in the days when everyone applied for a visa, one of the main requirements was showing that you have something to return to in your home country, a job, real estate etc.

The other thing that helped in those days was showing that one had a way to support oneself while here without working. I recall writing a letter stating that my step sister would be living at my house and that I would be financially responsible for her. She included that with a statement from her investment manager and convinced consular authorities she had no need or intention to work while here. I'm guessing that would be a red flag and not help you in any way.

Return visits to the U. Customs and Border patrol are based in both airports meaning your arrive in the U. Not only are you out the money for the flight, but you'll likely have to buy your flight back home, and last minute flights aren't cheap. Currently, you have to show that you are able to support yourself without working.

A B2 tourist visa is good for multiple entries, usually over 10 years. On each entry you can be admitted for up to days. But, yes, you must prove that you have such strong ties to the UK that you will absolutely want to return at the end of your visit. I'm no expert on this, but there is an immigration field office in Chicago.

If that's where you are, visting them to talk about how to arrange a return visit might make sense. It sounds like you are indeed an intended immigrant. Grounds to turn you away would seem solid. You want to know how to get around the law. You may want to consult an immigration attorney. I actually live in Chicago, and just went thru the 4 year process of getting my wifes Green Card, as she was here on a MBA Student Visa from China, a much different issue, as she had a work Visa too, and strong ties to home as well.

Anyway, you should consult an Immigration attorney. They have customer service people that will answer your questions, and they gave us the list of Non Profits to help with filling out all the endless forms for my wifes Permanent Status request.

Go back to UK and apply for a B1 Visa, then come here legally, then if you want to get married, you can go thru the process of getting a Green Card so you can be employed and work here, and legally change the status of your Visa, and start the process. The other option is for both of you return to UK, get married there, then you can apply for a Green Card from there, for Permanent Residency. Keep in mind the US Citizen you marry must prove they can financially support you as well, it is all explinaed if you just Google it.

You're allowed to get married here on the VWP. What you can't do is use that marriage to change your status and stay. You'd still have to leave. This topic has been locked by a moderator.
